1. Acceptance of Terms

By downloading, installing, or using BondGuard ("the app"), you agree to be bound by these Terms of Service. If you do not agree, do not use the app.

2. Description of Service

BondGuard is a mobile application that helps Australian tenants document property condition, log maintenance issues, capture timestamped evidence, and generate evidence packages for bond disputes. The app references Australian state and territory tenancy legislation but does not provide legal advice.

3. User Accounts

  • You may use the app anonymously or create an account with your email address, Google, or Apple sign-in
  • You are responsible for maintaining the security of your account credentials
  • You must provide accurate information when creating an account
  • One account per person; accounts are non-transferable

4. Subscriptions and Billing

  • BondGuard offers free and paid subscription tiers (Protect Plus, Legal Ready)
  • Subscriptions are billed monthly through the Apple App Store or Google Play Store
  • Free trials, if offered, convert to paid subscriptions unless cancelled before the trial ends
  • You can manage and cancel subscriptions through your device's app store settings
  • Refunds are handled by the respective app store

5. Acceptable Use

You agree not to:

  • Use the app to create false or misleading condition reports
  • Take photos or record videos in violation of applicable privacy laws
  • Submit fraudulent information about property conditions
  • Attempt to access other users' data or circumvent security measures
  • Use the app for any purpose that violates applicable Australian laws

6. Not Legal Advice

BondGuard is a property documentation tool, not a legal service. The app helps you create condition reports and evidence packages but this does not constitute legal advice. Reports generated by BondGuard may not meet all formal requirements of your specific state or territory tenancy authority. For legal matters, consult a qualified solicitor or contact your state's tenancy authority (e.g., VCAT, NCAT, QCAT, SAT).

7. Your Content

  • You retain ownership of all data, text, images, and video you create or upload through the app
  • You grant us a limited licence to store and process your content solely to provide the BondGuard service
  • We do not access, review, or use your content for any purpose other than service delivery

8. Disclaimer of Warranties

BondGuard is provided "as is" without warranties of any kind. We do not guarantee that:

  • GPS coordinates or timestamps will be perfectly accurate (accuracy depends on your device's hardware)
  • Condition reports will meet all legal requirements in every jurisdiction
  • Evidence packages will resolve any bond dispute
  • Tenancy legislation references are complete or current for every jurisdiction
  • The app will be available without interruption

9. Limitation of Liability

To the maximum extent permitted by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010), BondGuard and its operators shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the app, including any outcomes of bond disputes or legal proceedings.

10. Account Termination

You may delete your account at any time through the app's Settings screen or via our account deletion page. We reserve the right to suspend or terminate accounts that violate these terms.

11. Changes to Terms

We may update these Terms of Service from time to time. Continued use of the app after changes constitutes acceptance of the updated terms.

12. Governing Law

These Terms are governed by the laws of the Commonwealth of Australia and the State of Victoria. Any disputes shall be resolved in the courts of Victoria, Australia.
